Welcome to Nutsum. By accessing or using our mobile application and services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using our service.

1. Service Description

Nutsum provides AI-powered summarization of YouTube videos through our mobile application available on iOS and Android platforms. Our services include:

• Instant video summarization in multiple languages
• Bookmark organization and management
• Multi-device synchronization
• Search functionality across summaries
• Local and cloud-based data storage

1.1 Service Limitations

Nutsum can only summarize YouTube videos that meet the following criteria:

• Publicly accessible: Videos must be available to the public
• Subtitles required: Videos must have manual or auto-generated subtitles/captions available
• Not live streams: Live streaming content cannot be summarized

2. User Accounts and Registration

2.1 Account Creation

To use Nutsum, you must:

• Create an account with a valid email address
• Provide accurate and complete information
• Maintain the security of your account credentials
• Be responsible for all activities under your account

2.2 Age Requirements

Nutsum is available for users of all ages. However, users under the age of 13 must have parental or guardian consent to use the service.

2.3 Account Security

You are responsible for:

• Keeping your password confidential
• Notifying us immediately of any unauthorized access
• All activities conducted through your account

3. Subscription and Payments

3.1 Nutsum Pro Subscription

Nutsum Pro is available through in-app purchase on Apple App Store or Google Play Store, offering:

• Unlimited video summaries
• No video length restrictions
• Unlimited device access
• Ad-free experience

3.2 Billing and Pricing

• Subscription prices are set in your local currency through the respective app store
• Prices are subject to change with advance notice
• Subscriptions automatically renew unless cancelled
• Billing is handled entirely by Apple or Google

3.3 Free Trial

Free trial periods may be offered at our discretion or as configured in the app stores. Trial terms will be clearly displayed at the time of subscription.

3.4 Refunds

All refund requests are subject to the refund policies of Apple App Store or Google Play Store. We do not process refunds directly. To request a refund:

• iOS: Contact Apple Support or request through your Apple ID account
• Android: Request through Google Play Store or Google Play Support

4. User Responsibilities and Prohibited Conduct

4.1 Acceptable Use

You agree to use Nutsum only for lawful purposes and in compliance with these Terms. You must:

• Ensure content you submit is publicly accessible
• Respect intellectual property rights of content creators
• Comply with YouTube's Terms of Service when sharing links
• Use summaries for personal, non-commercial purposes

4.2 Prohibited Activities

You must NOT:

• Attempt to reverse engineer or decompile the application
• Use automated tools to scrape or harvest data
• Submit excessive requests that may overload our systems
• Violate any applicable laws or regulations
• Infringe upon intellectual property rights
• Redistribute or commercially exploit summaries without permission
• Share account credentials with others
• Attempt to circumvent subscription requirements

5. Intellectual Property Rights

5.1 Original Video Content

All rights to original YouTube videos remain with their respective creators. Nutsum does not claim ownership of any video content processed through our service.

5.2 AI-Generated Summaries

Summaries generated by Nutsum are created using artificial intelligence and are intended for personal use only. When sharing summaries, you must:

• Include direct links to original YouTube videos
• Clearly label content as AI-generated summaries
• Provide attribution to original content creators
• Obtain appropriate permissions for commercial use

5.3 Nutsum Platform

The Nutsum application, including its design, code, features, and branding, is owned by Nutsum and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works
• Distribute, sell, or sublicense the application
• Remove proprietary notices or labels

6. AI-Generated Content and Disclaimers

6.1 Accuracy of Summaries

Nutsum uses advanced AI technology to generate video summaries. However:

• Summaries are AI-generated and may contain inaccuracies
• We do not guarantee the accuracy, completeness, or reliability of summaries
• Users should verify important information against original video content
• AI interpretation may not capture all nuances or context

6.2 No Endorsement

Nutsum does not endorse, verify, or take responsibility for the content of videos processed through our service. We are a neutral platform providing summarization tools.

6.3 Content Responsibility

You are solely responsible for:

• Selecting appropriate and legally accessible content
• Ensuring compliance with copyright laws
• Verifying summary accuracy for important decisions
• Using summaries in accordance with applicable laws

7. Data and Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7.1 Data Storage

• Local Storage: Summaries are cached on your device for offline access
• Cloud Sync: Data syncs across your devices when logged in
• Deletion: You can delete summaries (7-day trash retention) or your entire account at any time

8. Service Availability and Modifications

8.1 Service Availability

We strive to provide reliable service but cannot guarantee:

• Uninterrupted or error-free operation
• Availability at all times (maintenance, updates, or technical issues may cause downtime)
• Compatibility with all devices or future OS versions

8.2 Service Modifications

We reserve the right to:

• Modify, suspend, or discontinue any part of the service
• Update features or functionality
• Change subscription plans or pricing with advance notice
• Implement usage limits to maintain service quality

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Nutsum is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim
• We are not responsible for third-party content, including YouTube videos or AI model outputs

10. Indemnification

You agree to indemnify, defend, and hold harmless Nutsum and its representatives from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your violation of any applicable laws or regulations

11. Termination

11.1 Termination by You

You may terminate your account at any time by:

• Deleting your account through the app settings
• Contacting support at support@nutsum.kr

Upon termination, your access will be revoked and your data will be deleted according to our Privacy Policy.

11.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Your account shows signs of automated abuse or excessive usage
• Required by law or legal authority

11.3 Effect of Termination

• Your right to access the service will immediately cease
• Active subscriptions may not be refunded (subject to app store policies)
• Provisions of these Terms that should survive termination will remain in effect

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.

12.2 Jurisdiction

Any disputes arising out of or relating to these Terms or the service shall be subject to the exclusive jurisdiction of the courts located in Seoul, Republic of Korea.

12.3 Dispute Resolution Process

Before initiating formal legal proceedings, we encourage users to:

1. Contact us at support@nutsum.kr to attempt informal resolution
2. Provide detailed description of the dispute
3. Allow 30 days for us to respond and attempt resolution

13. Changes to Terms

We may update these Terms from time to time. When we make changes:

• We will update the "Last Updated" date at the top
• Material changes will be notified through in-app notifications
• Continued use after changes constitutes acceptance
• If you disagree with changes, you must stop using the service

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nutsum regarding the service.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

14.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

14.5 Language

These Terms are provided in English. In the event of any conflict between the English version and any translation, the English version shall prevail.
